RELEASE AND WAIVER OF LIABILITY AGREEMENT  

 

I acknowledge that I am voluntarily attending MIDWEST TACTICAL SYSTEM’S (aka: VIRTUS TACTICAL TRAINING) ARREST AND CONTROL INSTRUCTOR COURSE instructed by Cullan McHarg (“Instructor”), the president/CEO of Midwest Tactical systems LLC (aka: Virtus Tactical Training) and Max Yakovlev (“Co-Instructor”). I acknowledge that the instructor(s) listed herein, are instructing this course as a private citizen(s) and is/are not representing any government agency. I hereby agree to participate in the above listed course, which consists of static and dynamic combative use of force activities, theory and techniques designed to quickly incapacitate a(n) assailant(s) and control active and aggressive subject(s). The techniques taught, demonstrate and drilled in this course may be hazardous and may present a serious health risk. 

 

I AM AWARE THAT THE ACTIVITIES BEING TAUGHT ARE INHERENTLY HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR KILLED WHILE PARTICIPATING IN THESE ACTIVITIES.  THIS COURSE CONSISTS OF STRENUOUS PHYSICAL ACTIVITY, INCLUDING BUT NOT LIMITED TO: STATIC AND DYNAMIC COMBATIVE USE OF FORCE ACTIVITIES, THEORY AND TECHNIQUES DESIGNED TO QUICKLY INCAPACITATE A(N) ASSAILANT(S) AND CONTROL ACTIVE AND AGGRESSIVE SUBJECT(S). I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGERS INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, HARM, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.  

 

As consideration for being permitted by the Instructor(s), I forever release the instructors, any of the Instructors’ respective directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releasees”) from any and all actions, claims, or demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or, whether or not I am then participating in the activities.  I also agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the foregoing release.  

 

I ATTEST THAT I AM IN GOOD HEALTH, NOT INJURED IN ANY WAY, NOT UNDER A PHYSICIAN’S CARE FOR ANY AILMENT AND HAVE NO EXISTING OR PRE-EXISTING HEALTH CONDITIONS OR INJURIES WHICH MAY PRECLUDE ME FROM PARTICIPATING IN THE ABOVE LISTED TYPES OF ACTIVITIES.  

 

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS  CONTENTS.  I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE INSTRUCTOR(S) OF THIS COURSE AND BY CHECKING THE BOX BELOW, i AM AGREEING TO ALL THE TERMS OF THE ABOVE WAIVER.
